JUDGMENT IS REVERSED IN THE ASSAULT CASE HIS HONOR JUDGE YOUNG SUSTAINS APPEAL OF w. . wit- LIAMS IN RECENT ASSAULT CASE ON A MORE COM- PLETE PRESENTATION OF EVIDENCE The last seene in the pretty little comedy that has been oc- cupying the = attention of the courts for the last few days was enacted in Judge Young's court yesterday afternoon, when the appeal in the police court case against the finding of Magistrate MeMullin, in the charge of as- sault brought by Mr. Frank A. Ellis against Mr. W. E. Williams was sustained by His Honor Judge Young. The case which arose out of the now famous Prince Rupert Fish and Cold Storage Co., Lid., dispute as to the possession of the company’s minute book and _ records has been pretty well aired in the lo- cal press. Mr. Williams, who was adjudged guilty of assault upon the evidence taken by Mag- istrate MeMullin yesterday morn ing and fined the nominal sum of $5.00 and costs, immediately appealed from the decision of the magistrate. This was granted, security of $50.00 being put up for his appearance in the higher court. Upon coming up for hearing before His Honor Judge Young in the afternoon, Messrs. Ellis and Bacon as. complainants, again told their story of the alleged as- being subjected to a len- gthy and searehing cross-exam- nation by Mr. A, M. Manson. Mr Williams, the defendant, sault, in a concise fashion affair, and straightforward gave his version of the absolutely denying any attempt at assault. He merely, he said resisted an attempt made by the complainants to forcibly take the minute book from his possession. Mr. A. M. Manson, who was acting as counsel for his partner, threw off his legal gown and took the stand in the witness box, corroborating his partner's evidence as to the at- tempt made by the complainants to get possession again of the elusive book that has oceasioned so much perturbation. Following Mr. Manson, Mr. H. A. Philpott, the secretary-treasurer of _ the company, was called and gave evidence along practically . the same lines as that of the two previous witnesses. Before the close of the latter’s cross-exam- ination by Mr. W. E. Fisher, His Honor pointed out to the prose- cuting counsel the exact status . of the case. Without calling up- on counsel for either side for ar- gument, His Honor announced that from the case presented be- fore him he had no choiee but to reverse the decision of Magis- trate McMullin.
