Ee TuHurRspDAy, Dec. 14 “NOT A LEG TO STAND ON.” After a long and costy trial the city authorities have learned from the lips of a learned judge of the Supreme Court that which any humble citizen could have told them for nothing: namely, that “in point of substantial justice and common hon- esty they had not a leg to stand on” in refusing to pay the contractors’ bills. Indeed, these were almost the very words used by Alderman Morrissey when he entered protest against the actions that City Solicitor Peters was urging the city to take part in. “It will only cost the city three hundred dollars, and it’s worth that to us to find out the law,” declared an alderman. The city has learned the law; it would be interesting to know at what cost. Mr. Justice Clement has had previous knowledge of the ways of Prince Rupert iocal authorities. He it was who tried the Prudhomme case, and his scathing words in issuing the mandamus to renew the license will be remembered. The same attempt to play petty politics with the public offices was apparent in both cases. The pity of it is that the ratepayers in both cases will be called upon to pay the bills. It would be easy to write columns in scorn of the conduct of the Council, but columns of scorn cannot undo the past, and the Council is too near its end to be worth many words. All that is not worth bothering about is to see that for next year a new Council, composed of non-politica! business men, is elected to carry out the affairs of the city on a non-political basis. The ideal form of civic government—the only form that offers scope for specialised administration under democratic control—is government by commission. That, even in a modi- fied form, has been denied the citizens by the Provincial Govy- ernment, who seemingly view with disfavor the possibility of a non-political city government, Until such time as a party of progress can revise the Municipal Clauses Act, there is nothing for the citizens to do but elect—if they can—a Council of non- party business men and run the city as far as our human de- ficiencies and failings permit on strictly business principles. To keep itself above suspicion, The News has purposely refrained from mentioning the names of anyone or either mayor or council. In exhorting others to refrain from political dis- tinctions in civic affairs, it is prepared to show the way. The utter defeat, the shaming that the civic authorities have subjected the citizens to in their efforts to play petty poli- tics with the will the for bitterness or diatribes, but rather to urge the citizens to rally contractors not be made occasion to the standard of a non-party civic administration.
