This question, propounded by the City Solicitor at last night’s Council meeting, is one that presumably the citizens at large are invited to give answer to. There are a number ot things that the city might do to improve the situation in its legal entanglements. Among these The News suggests: (a) Quit playing politics with the ratepayers’ money. (b) Fire the City Solicitor and engage a cheaper one at a larger salary. (c) Insult the bench by raking up the past of any judges who are against the city, and stigmatise them as “political cowards and quitters’? in the pages of the City Hall Journal. (d) Send a deputation down at the city’s expense to ex- plain the situation to our friends at Victoria, and have them pass a special bill to ratify the City Solicitor’s report at the next sitting of the Legislature. Outside of this there are only two other things to do, One is to accept the judgment of the court like an honorable body and settle with the contractors, both in the interests of econ- omy and of justice; the other is to Mr. Justice Clements himself phrased it) “bear the odium of taking to appeal on a dubious point of law, a case in which in point of substantial justice and common honesty they have not a leg to stand on.” The City, on the advice of the City Solicitor, in a case equally repugnant to all sense of justice (the Prudhomme case), once went to the Court of Appeals before. It was a judgment of Mr. Justice Clements that was sought to be upset. This lesson, if it has been lost on the city authorities, has not been lost on the citizens, Even at this late hour the Council would probably find it cheaper and easier to do the honest thing and settle with the contractors on the lines indicated by Mr. Justice Clements’ judgment. This would not only fit in with common honesty and substantial justice, but also with the opinions and prac- tice of the honorable citizens and ratepayers of Prince Rupert. (as NOTES AND COMMENTS. A couple of weeks ago, when n the increase of $100 a month to the City Solicitor was proposed, The News remarked that a good lawyer is cheap at $250 a month, but wouldn't it be safer to wait and see how the contractors’ turned out.
