The Supreme Court of Canada early this year held that the defendant fishery officers were entitled to protection of the Pro- viricial Magistrate’s Act. The issue now is whether defendants acted beyond the scope of the impugned sections of the Fisheries Act and thereby lost protection of the M1- gistrates’ Act. The plaintiff alleges that defendants acted outside the statute, exceeded their duties as fishery officers and discrimin ted ;ogainst the Somerville Cannery Co.
