Hicks, who arrested Shaw later, told the court that in his opinion the accused was "crazv durnk" at the time of his arrest. When' Hicks attempted to take him into custody he reported Shaw as saying: "Leave me alone oi I'll throw you in, too." He said that Shaw was so violently drunk that outside help was required to put him in custody. He was handcuffed and taken to. Jail. Daniel Peppin, who is now under sentence for supplying liquor to an Indian, told of buying liquor for people aboard a boat in the afternoon and of accompanying Shaw into the beer parlor in the eveningWhen he and Shaw left the beer parlor at closing time, they carried three cases of beer which Shaw had purchased.
