O. rews assistant city engineer, who gave details of a plan showing the surroundings of the accident which t(K)k place near the intersection of Fifth Avenue and Young Street. Mrs. John Manson, the first eye witness, to he called, said that ahoul S. 50 on the afternoon of Fehruary 12 she was coming up Fifth Avenue from Mcltride Stj-eet. She had her two children with her. As she was approaching Young Street she saw Norma1 Muuro standing in the middle of Fifth Avenue. She also saw a rar approaching from the oppo- ite direction. She saw the driver turn ia close lo the curh to the right. All at once she saw the car crowd very quickly into the sidewalk. Norma Monro was in front of the car. She then saw the right wheels of the cari strike the sidewalk. There was a noise as of t i iv and' (hen the grating of hrakes. The driver turned off hi engine and got out. He ask ed if-she had seen what had haj- pened and I hen said, "My Cod I She's dead." He then went up the street towards Munro'a house. Some Possibilities Under cross examination hy Mr. I'atmore, Mrs. Manson said she helieved Ihe car would have passed the child safely if the child had remained where it was when she had at first seen it. She saw no skidding and could. not say at what point the driver, had put on the hrakes. If the carl had heen going faster, the child would have heen safely passed and Ihere would have heen not accident she thought. "As far as you could see, Mrs. Manson, the driver was not negligent?" asked Mr. I'atmore. "As it looked lo mc the driver did what he thought would save the child, " replied Mrs. Manson after some ohjection - had heen laken iy Mr. Manson lo the question which was allowed in cross-examination hy His Lordship. "The child moved very sud denly in relation to the car?" asked Mv. I'alm.ore. "Yes," was the answer. Mr. I'atmore "Since this accident, you have heen ohserving the speeds of cars ronsiderahly ? Not Driving Fast Mrs. Manson "Yes, and the result was that I came lo the t'oiiclusfon that I was quite right when I said the driver 'in this case was not driving fast." Mr. I'iitmore "The children in this town use. the roads very" ronsiderahly as playgrounds?" Mrs. Manson "Yes."- His Lordship "All over Canada they do." Mrs. McRae Witness Mrs. Duncan Mcltae, who was approaching Fifth .venue along Young Street from Fourth Avn.. in giving evidence, staled she had heard the noise of grating and grinding as if (wo cars were scraping. The lKdy was on Ihe proper side of Ihe road in relation to the. car, Mrs. Mcllae said in answer In His Lordship. Doctor's Evidence Dr. L. W. Kengin, the first physician in attendance, testi fied as lo the injuries "sustained hy Norma Muuro. Thexe in juries consisted of a fracluro at the hase of Ihe skull which was Very extensive. She was hleeding from holh ears and the nose. She was unconscious and I here were few ahrnsions on Ihe face. The .important injuries were those to the head. Under witness' in slrnctioiiSi deceased was taken lo Ihe hospital where 'nhe' died after hejng given appropriate treatment. There was an ex tensive laceration lo the hrain which was brought ahoul hy a very severe hlow. A statement made hy Dr. W. T. This bore further on the nature of the injuries. Two little girls, Annie Smith, 13, and Kdna Fdgar, t f, were the next witnesses. Itoth were in' the vicinity at the lime of the aceident 'and gave particulars wilh regard loil. Neither of them remembered having heard any warning signal such as thu sounding of a horn. Heard No Warning Mrs. Manson and Mrs. Mcllae were recalled by Ihe crown. They iid mil hear Ihe car give a vvarning signal. Mrs. Manson iiinlificd this, under cross-exam ination, by saying that if a varniiig had been given it might not have heen impressed on her mind. Mrs. Mcltae said that she as some 350 feet away and might not have remendtei-eil tearing a warning signal. It skidded 18 feet when brakes were applied after being driven at a rale of 17 miles an hour. At a rale of nine miles an hour it had skidded nine feet.
