McNeill K.C. of Vancouver was appointed by the crown to conduct the appeal of Karl Fredericks, young German, against a death sentence Imposed at the last session ot the Supreme Court Assizes in Prince George for tfie murder In June of last year of his two companions, Mux Wcstphal and Jler-man Peter. In the vicinity of frcm-bleur Lake. The crown Is financing the appeal of Fredericks who Is without funds. The proceedings started last week in Vancouver. A. R. McDougall is assisting Mr. McNeill in the presentation of the appeal. At the opening session of the Court of Appeal, permission was granted Fredericks to present his grounds of appeal. The ground on which a new trial was asked was that a statement made by Fredericks to the police at Trlnce George on December 8 was not admissible in evidence. A. M. Johnson K.C., crown counsel, refused to submit the statement at the trial but It was admitted In evidence by the trial Judge when submitted by the defence. It was also claimed that the trial judge had failed to Instruct the Jury with respect to the statement. The Court of Appeal reserved its Judgment until November 24. Fredericks Is under sentence to hang on December 3. Fredericks, who Is 32 years old, still insists that he wos not the slayer of Max Westphal but that Herman Peter committed the deed and then committed suicide. Fredericks claims that he concealed the bodies for fear of suspicion being cast upon him.
