The law is designed to give every elector a vote and to provide that his intention shall be f?rue?, th same time there must be no mark on the ballot which might be interpreted as doing away with the secrecy of the poll, a feature which in this country is J valued so highly. If a ballot is marked with a stroke instead of a cross and is otherwise correct, it be may argued that the voter intended to vote for the candidate designated. Yet a returning officer may argue that putting a stroke instead of a cross opposite the name distinguishes that ballot from the others and, therefore, it should be invalid. . In past judicial recounts County Court judges have usually taken the view that, if it was evident who the voter wished to vote for, the ballot should be allowed unless there was some evident attempt made to tamper with the ballot by marking it in such a way that it was clear he was trying to make known that it was his ballot. Ballots marked with a stroke have been allowed and also those marked with a cross close to the. name instead of in the place intended for the cross. That seems to have been the view taken by Judere Ellis in Vancouver which resulted in the election of Mr. McGeer. Other iudges might take different views and that is why an effort is being made to take it before another judge since the C. C. F. has suffered from the ruling of Judge Ellis. In spite of the fact that only twenty percent of the population were affected by the spirit of unrest, it should be strongly urged upon members of Parliament and political leaders that the disaffection . has made sufficient headway to indicate that, if something is not done to improve conditions, it is likely to grow in influence and power.
