Witnesses testified that Pudbury had walked Into Mrs. Nog- ,'ins chicken pen last Tuesday light, killed seven or her Rhode Is-and roosters and taken them home vith him atter setting tire to the hen house. Pudbury explained to Magistrate Hall that he had been forced to this action purely In selt derense. He said he had happened to be In Airs. Noggin's chicken pen at mld-aight Tuesday, while out strolling n me moonlight, and had been vic-ously attacked by a Rhode Island Sed rooster. In order to defend limseir It had been necessary not inly to kill the rooster but six )thers as an example and to burn ;he hen house so that there would be no recurrence of the assault up- 5n his person. 'All I'm trying to do, Yer Honor." Pudbury said to the magistrate, "is to be neighborly with Mrs. Noggins ind to co-operate with her. For years I've bin tryin' to co-operate with her, Yer Honor, but she won't :o-operate. I thought I would Just teach her a lesson in co-operation, rhat there is the only reason I killed the roosters and burned down the hen house. It was Just good old fashioned neighborliness, what I mean." Uooster Sticking Pudbury complained vigorously against the treatment accorded him by Mrs. Noggins. He said that he had been viciously attacked by her m a premeditated fashion after he had killed the roosters and burned the hen house. He said Mrs. Nog gins had come out of her house in her night clothes and called him bad names "such names, Ye Hon or, as I would not disgrace this court with repeatln or 'em here" and had rurther assaulted him with her rists in a most brutal rashion. Purely in seir-derense, he said, he had been iorced to knock Mrs. Noz- glns down and tramp on her. "I just tramped on her a little," he said, "not much, you understand. but Just enough so as to derend my-seir." It was rortunatc, he said, that he happened to be wearing hob nailed boots at the time. Taking- Control Pudbury said he had round it necessary. In order to protect his interests, to take complete control or the Noggins' chicken pen and had put his son, Jim, In charge or it. He wanted It understood, however, that Jim, while operating the chicken rarm, was doing It only for the Noggins' own good. "Jim Is Independent, what I mean to say," Pudbury testified. "I have no control or him. He Just gives me all the eggs, that's all. It's a neighborly arrangement, as you might say." Magistrate Hall said Pudbury deserved heavy punishment. He lectured the accused severely and said mat next time he burned Mrs. Nog- gins' hen house he should give hcrl a day's warning so that she could j leave ncr nouse and avoid the dan ger or being burned also. Meanwhile the Saanich Council i met In special cession to consider Pudbury's outrage. Councillor Wrlggledown proposed that the municipality retuse to buy any more or, Pudbury's barnyard fertilizer fnr1 the rose gardens at the Royal Oak Municipal Hall but the council explained that Mr. Pudbury might refuse. In retaliation, to pay his taxes or even to patronize the various stores, garages and other hnsWi enterprises owned by members of me council. The Reeve said Pudbury had struck him violently In the paw a rew days ago but, as he had made a complete apology explaining that he had never intended to hit the Keeve in the Jaw but only in the stomach, It was felt that the Incident might well be overlooked, Councillor Wrlggledown said Pudbury had chopped down some of his cows. Franklin's Plan Councillor Franklin Delano made a rousing appeal to his colleagues and the public at large to rally together against all breakers of the peace like Pudbury and to quarantine them lest general anarchy spread throughout the municipality but he said he could do nothing, of course, to Interfere with his profitable trade with Pudbury In groceries and hardware. Pudbury himself appeared before the council and said he was amaz ed to find that this honorable bodv had quite misunderstood his entire attitude. It was incredible to him, and extremely palnlul, he said, to rind such old rriends as Wriggle-down and Delano imagining Tor a moment that he Intended any harm to Mrs. Noggins or anyone or that he had any intention ot taking other people's property. Never had It crossed his mind, even when he ate the Rhode Island Reds, to appropriate other people's property. He thought the council ought to apologize to him lor Its unjust sus picions. In the end the council passed a vigorous resolution pro t es 1 1 n g against Pudbury's actions as being contrary to law. The council then adjourned to Mr. Pudbury's house to enjoy coltee and cold chicken sandwiches. VANCOUVER CATTU: MARKET IS ACTIVE VANCOUVER.
