Earl Johnson, 34 - year - old fisherman charged with the murder of his brother, Vivian "Vic" Johnson, aboard the seine boat Izumi III here Saturday night, appeared in city police court this morning and heard charge of murder read to him by Magistrate W. D. Vance. The tall, dark-skinned fisherman was remanded for eight days or earlier for preliminary hearing on the murder charge. Since the hearing will be a preliminary examination, no plea was entered by Johnson's counsel, M. Willa Ray. Both Mrs. Ray and , Crown Counsel T. W. Brown agreed to the adjournment so that the Inquest Into Vic Johnson's death can be completed before the preliminary hearing starts. Police documents which had listed the name of the dead man as "Vic" Johnson were changed 'when the accused man told the court that his brother's name .had been Vivian Charles James Johnson. The inquest Is scheduled to begin at 2 p.m. Tuesday. Three men who had been held as material witnesses over the week-end were released this morning after they had assured Magistrate Vance that they would be on hand to give evidence at the Inquest and pre liminary inquiry. They were I Clifford Johnson, youngest brother of the slain man.
